International protection of a company and service trademark
Initial situation
One of my clients in an international company operating in the field of mystery shopping. In mystery shopping the quality of the advice when selling products and when furnishing a service is checked by concealed test purchases or concealed used services. A company can commission a check for itself in order to determine how it stands with regard to quality compared to the competitors. The result of the check can be used for example to improve the quality and for training employees.
Aim
The logo and the trademark with which my client appears in international business dealings is to be protected.
Solution
In intensive discussions with my client I firstly determined the countries in which protection is required for the logo and designation. In addition, I defined the field of activity precisely since a trademark application being considered must comprise a list of goods and services which is as clearly defined as possible for which protection is requested. As a result of the business activities of my client in many countries of the world, protection of the company and service trademark within an international trademark application emerged as the best option. Following application of the trademark at the WIPO in Geneva and successful registration my client now has protection for his trademark in more than 40 countries worldwide and is thus distinguished from his competitors.
